株式会社ポケモンは、ゲームアプリ「口袋妖怪：复刻」（別名「口袋之旅」）の運営者らに対し、2021年12月3日に提起しておりました知的財産権の侵害訴訟において勝訴いたしました。

広東省深圳市中級人民法院において、ビデオゲーム『ポケットモンスター』シリーズの著作権の侵害行為及び不正競争防止法の違反行為が認定され、广州麦驰网络科技有限公司には損害賠償金1.07億元（約23.4億円。2024年7月12日のTTMレート1元当たり21.89円で換算）の支払いを、深圳市阿斯卡德信息技术有限公司、深圳市值尚互动科技有限公司及び霍尔果斯方驰网络科技有限公司には損害賠償金の一部の連帯賠償責任の負担を命じる判決が、2024年7月12日に下されております。
 

なお、广州麦驰网络科技有限公司及び霍尔果斯方驰网络科技有限公司は控訴を提起しております。

Court Rules in Favor of Pokémon in Intellectual Property Infringement Lawsuit in China

The Pokémon Company received a victorious verdict in its lawsuit filed in China on December 3, 2021 against the operators of the game app “Pocket Monster: Remake (口袋妖怪：复刻),” alias “The Pocket Journey (口袋之旅),” claiming infringement of intellectual property rights.

On July 12, 2024, the Shenzhen Intermediate People’s Court in Guangzhou Province ruled that copyrights of Pokémon Video Game Series had been infringed and that the defendants had also violated the Unfair Competition Prevention Act. The court ordered Guangzhou Maichi Network Technology Co., Ltd. (广州麦驰网络科技有限公司) to pay damages in the amount of 107 million Chinese yuan (approx. 2.34 billion Japanese yen, based on Telegraphic Transfer Middle Rate of 1 CNY = 21.89 JPY in effect on July 12, 2024), with partial joint liability to be borne by Shenzhen Asikade Information Technology Co., Ltd. 深圳市阿斯卡德信息技术有限公司), Shenzhen Zhishanghudong Technology Co., Ltd. (深圳市值尚互动科技有限公司), and Khorgos Fangchi Network Technology Co., Ltd. (霍尔果斯方驰网络科技有限公司).

Guangzhou Maichi Network Technology Co., Ltd. and Khorgos Fangchi Network Technology Co., Ltd. have filed appeals against the court’s ruling.
